Gunshots, arrest at Crestview Gardens

NEW CASTLE — City police were called for two bouts of gunshots at Crestview Gardens Thursday morning.

A woman told officers she had been sitting in a chair outside the door of a Pin Oak Drive building about 1:50 a.m. when she heard gunshots and ran inside. The woman said she had felt something graze her head, but did not see anyone and did not know where the shots had come from.

Another woman from the building told officers she had been sitting on the second step when she heard gunshots. She also said she had run into her apartment without seeing who had shot the guns or from where.

New Castle police said they found damage that might have been caused by a bullet at the entrance of 1110 Pin Oak Drive, and evidence that a bullet had been shot through a chair just outside the building. Bullet fragments also were found inside the doorway at the bottom of the steps and there was fresh damage on the step.

A .40 mm shell casing and a 9 mm shell casing were found across outside 1109 Pin Oak Drive and a bullet hole was found in the rear passenger door of a gold Grand Am parked outside 1110 Pin Oak Drive. Bullet fragments were retrieved from inside the car.

Police were told a witness from a nearby building had looked out a window and saw a man in a red hoodie with black and gray squares on the back shooting a gun towards 1110 Pin Oak Drive. The witness said the shooter then ran behind 1109 Pin Oak Drive and into the woods. The witness said four to six others also ran into the woods.

Police were called back to Crestview Gardens about 4:30 a.m. Thursday by a resident who told them the living room couch where he had been lying had been hit by a bullet.

The resident said he had heard gunshots and took cover.

Police said the victim recovered a bullet fragment from the couch prior to the officer’s arrival. They saw a hole in the wall of the apartment next to the couch, marks on an outside wall and another hole in the living room window of a nearby apartment, police said.

A .40 mm shell casing was recovered at the base of a tree directly behind the apartment.

Later Thursday, police arrested Anthony Wayne Phillips, 52, of 1144 Pin Oak Drive on charges of disorderly conduct, resisting arrest, possession of a controlled substance and possession with intent to deliver a controlled substance.

Called to Pin Oak Drive about 11 a.m., officers encountered Phillips, who they said shouted obscenities at them.

Police said they Tased Phillips when they tried to arrest him but he pulled the Taser prongs out of his body. Officers then deployed the Taser into Phillips’ shoulder, forced him to the ground and deployed the Taser into his back.

Upon searching him, police said, they found a bottle containing 32 pink pills and a second pill bottle containing 44 pink pills.

He was arraigned before District Judge Melissa Amodie and jailed in lieu of $15,000 bond.
