Pair faces drugs charges after Croton confrontation

NEW CASTLE — A New Castle man is free after posting $100,000 bail on drug and gun charges.

Marquis Leon Gardner, 32, of 215 Bellview Ave. was charged by New Castle police after an incident on Bellview Avenue around 3:30 p.m. Sunday.

Officers said Gardner had to be Tased after he kept reaching into his pants and ignored commands to stop. They also said a gun was found in a city police cruiser after Gardner had been sitting in it after his arrest.

Also arrested was Sanford Lynn Jackson Jr., 30, of 730 Court St.

According to police, officers were on patrol on North Crawford Avenue near Croton Avenue when they observed four men in the vicinity of what is considered a “high-volume drug trafficking area.”

Upon seeing the officers, police said, two of the men walked to the backyard of a house and were later seen running toward Bellview Avenue, which parallels Crawford.

When officers confronted the two men, identified as Gardner and Jackson, they asked if they had any weapons. Officers said Gardner kept reaching toward the waist of his pants. When instructed to stop, police said, he began to back away from them and officers stopped him, suspecting he might have a weapon.

Police said Gardner resisted and they Tased him. However, they said the effort was ineffective because Gardner was wearing a heavy sweatshirt and both prongs of the Taser did not penetrate to the skin.

Officers said they wrestled Gardner to the ground and when he was searched, they found a bag of suspected crack cocaine that field tested positive. The weight was 9.2 grams.

Gardner was taken to the New Castle police station. Later in the day, an officer found a .45-caliber handgun in the back seat of the cruiser where Gardner had been.

Gardner was charged with possession of a controlled substance with intent to deliver, possession of a controlled substance, resisting arrest, disorderly conduct, illegal possession of a firearm and carrying a firearm without a license.

He was arraigned on the charges and ordered held on $100,000 bond. He was able to post bail Monday.

Meanwhile, because police said Jackson was with Gardner, they searched him and said they found a bag with suspected marijuana and another with suspected heroin. They added a more thorough search of Jackson at the police station netted additional items suspected to be marijuana and heroin.

Jackson was charged with four counts of possession of a controlled substance, possession of drug paraphernalia and two counts of possession of a small amount of marijuana.

A preliminary hearing for Gardner is scheduled for Wednesday, and one for Jackson is scheduled for June 25.
