Man arrested in East Side disturbance

NEW CASTLE — A car that became stuck in a yard prompted a disturbance that resulted in an East Side man’s arrest.

New Castle police have charged Johnathan B. Malinchak, 24, of Rear 811 1/2 Franklin Ave. with aggravated assault, prohibited offensive weapons, simple assault, recklessly endangering another person, disorderly conduct, harassment, driving under the influence, highest rate of alcohol, possession of a controlled substance and possession of drug paraphernalia.

Police said the incident occurred in the 600 block of Forrest Street around 9:10 p.m. Wednesday after Malinchak’s Jeep had become stuck on tree stumps.

The property owner said that when he told Malinchak he intended to call the police for an accident report, Malinchak screamed threats and pulled a collapsible baton out of his Jeep. He extended it and went after him, hitting him in the upper left arm with the baton.

A neighbor threw Malinchak on the ground to stop the attack, according to witness accounts.

Police said Malinchak appeared to be under the influence of alcohol and he told them he had smoked marijuana. They found a portable scale with suspected marijuana on it and a broken narcotic pill in his pockets.

They impounded his Jeep and found brass knuckles in the center console.

Malinchak was arraigned by District Judge Melissa Amodie and jailed on $5,000 bond.
