On March 28, a vote was held to appoint two candidates to the Historical Architectural Review Board. Regardless of whether the results change or remain the same, I believe the vote was invalid.
Two HARB positions for candidates were open. However, two New Castle City Council members voted for more than two candidates. Stated in Roberts Rules of Order, “If a member votes for more choices than positions to be elected, the vote is considered illegal.”
Additionally, the resolutions to appoint nominees to the HARB were tabled on the agenda for several months.
It is also stated in Robert’s Rules of Order, “A motion that was laid on the table can only be taken from the table during the remainder of the meeting at which it was laid on the table or before the conclusion of the next regularly scheduled meeting.”
It further states in Robert’s Rules of Order, “If not taken from the table within these time limits, the question dies.”
Two rules of order were violated. Council can easily set the record straight by revoting.
City council must set the example. It is incumbent upon council to follow the rules of order if they expect the citizens of the city to respect the laws and ordinances.
