NEW CASTLE —
A closed bakery on the city’s East Side is not likely to reopen.
Anthony Cast, the owner of Cast’s Bakery at 1033 E. Washington St., was found guilty on two of three citations that were filed against him last month by New Castle’s health officer, Patrick McGuire.
The building owner also received approval from District Judge Melissa A. Amodie yesterday to proceed with eviction.
Cast appeared in Amodie’s court for a hearing earlier this week on the health code citations.
He was fined $75 plus court costs for each of the two offenses: Violation of clean air by having cigarette smoke in his establishment and of not having a food employee certificate.
Cast was cleared of a third citation with a list of about 30 code violations through an agreement between his attorney, John DeCaro, and McGuire.
McGuire said he won’t refile the third citation because it was settled through a plea bargain for the other two guilty decisions.
McGuire said yesterday that if Cast should decide to reopen his bakery, he would have to apply for a new license.
Under the city’s health ordinance, his application would be considered based upon previous health code violations and Cast’s meeting all of the qualifications of a food establishment.
Cast also would have to obtain a certificate of use and a new tax identification number, then obtain food employee certifications within 90 days of reopening.
Cast’s plans also would be complicated by the outcome of the eviction hearing yesterday initiated by building owner Charles Turok.
Cast said yesterday he intends to file an appeal to the two guilty findings on the citations.
He said his lease in the building expires in November, but is not planning to renew it, regardless of the eviction outcome.
McGuire explained that whether or not Cast had been found guilty of the citations, the health violations still stand.
“Those (citations) were in addition, as a penalty for the violations,” he said.

A hearing on the status of a boy accused in a 2009 fatal shooting has been canceled. The hearing on 15-year-old Jordan Brown’s detention had been planned for Lawrence County Court today, but was canceled after prosecutors requested, and received, a stay in the proceedings.

Suspect in officer’s death is arraigned
Kylee Barletto was arraigned this morning by District Judge Jerry Cartwright. She is being lodged in the Lawrence County jail on $250,000 bond. Barletto, 25, is charged with homicide by vehicle and 14 other counts in the May 2 death of Shenango Township police officer William J. McCarthy IV.
