Accused child rapist found guilty

NEW CASTLE — An Edinburg man accused of sexually molesting a child has been found guilty on all charges.

George Franklin Rathy Jr. 33, of 159 Jane Lane, was found guilty on Thursday following a three-day non-jury trial before Lawrence County President Judge Dominick Motto.

Rathy, who testified on his own behalf during the trial, was found guilty of rape of a child, attempted rape of a child, involuntary deviate sexual intercourse with a child, attempted involuntary deviate sexual intercourse with a child, and indecent assault of a child.

Following the guilty verdict, Rathy faces a mandatory minimum sentence of at least 10 years in prison. Under Pennsylvania sentencing guidelines, he could face a maximum of 40 years in prison. Sentencing is anticipated at 2 p.m. on Feb. 8, 2013.

The charges stemmed from a 2008 incident when Rathy was accused of sodomizing an 8-year-old victim in North Beaver Township.

Testifying were Trooper Harry S. Gustafson, Jr., of the New Castle station of the Pennsylvania State Police who filed charges, safe nurse Suzanne Costello of Jameson Hospital. Also testifying was the victim, who is now 12 years old, and the victim’s mother.

According to police reports filed in the case, Rathy was accused of assaulting the victim during Christmas break in December 2008, and warning the victim not to tell anyone.

Assistant District Attorney Jonathan R. Miller prosecuted the case. Rathy was defended by attorney Michael Nahas of Pittsburgh.

Following the guilty verdict, Miller requested that Rathy’s bond be increased to $100,000. He had been in the Lawrence County jail on $75,000 bond since his arrest on April 7, 2011.

The Lawrence County commissioners have decided to solicit proposals for the private operation of the county jail. Good idea?

Yes. If it’s a more efficient way to run the jail, I’m all for it.
No. I think there would be too many questions of liability for the county.
Not sure. The county seems to be doing a good job of running the jail now. Why break it if it’s not broken?
